The role of science and awareness in concluding the contract and adapting them to the functions of intelligent systems in this regard.

چکیده

Concluding a contract is a voluntary act that requires science and awareness. Knowledge of the nature of the contract, the subject matter of the transaction (type, description, and quantity), the parties to the contract, its terms and conditions, and other related matters is essential. Humans possess the inherent ability to understand these matters and conclude the contract. However, artificial intelligence is also used in contract formation nowadays. Hence, the question arises: Can artificial intelligence possess the necessary human cognitive abilities for contract formation in terms of understanding and eliminating uncertainty in its conclusion? The results of the current study show that artificial intelligence, with the exception of direct knowledge, performs a similar function in the field of acquired knowledge and its branches. Accordingly, it can be concluded that by developing the capabilities of artificial intelligence in this regard, and disregarding some of the contract's conditions, contract formation can be entrusted to artificial intelligence. The purpose of this article—using a descriptive and analytical approach—is to study the types of sciences and cognitive abilities, both potential and actual, possessed by artificial intelligence, and their potential application in contract formation. This research, by demonstrating the measurement and perception functions of systems, provides a basis for a positive response to the hypothesis of assigning contracts to intelligent systems.
