When God grants a human being an instinct, He permits its practice within a specific framework. Most of the cases criminalized in the Holy Quran relate to human transgression of this framework. This undoubtedly reflects the verse: “And whoever transgresses the limits of God has certainly wronged himself.” The obligation to observe the hijab and cover women according to Islamic law is one of these frameworks, and it is a means ordained by God to control individuals’ sexual instincts. Given that failure to adhere to the Islamic hijab is considered a crime in Islamic penal law, this study—using a descriptive and analytical library research methodology—examines the foundations for criminalizing this act in the Holy Quran. The results of the study indicate that failure to adhere to the Islamic hijab, based on an examination of the verses on hijab, has been criminalized with the aim of protecting society’s moral values, social order, and public safety for individuals, and preventing the spread of indecency and prostitution, which is consistent with the three elements of criminal law.
