Conflict of Expert Opinion with other Evidences of Proof from the Perspective of Islamic Jurisprudence and Iranian Law

In some cases, such as identifying the external instance of the subject, the expert opinion is an independent evidence, and in some cases, such as proving the crime, it is a sign of the judge's knowledge. In both cases, the expert opinion may conflict with other evidence.
If the expert opinion conflicts with other evidence such as the judge's knowledge, testimony, admission, oath and oath, if the expert's opinion is one of the cases that constitutes independent evidence, the first rule is that the judge's knowledge precedes all instruments in jurisprudence and law, so the judge's knowledge precedes the expert's opinion if his opinion is contrary to the judge's knowledge, and the admission also precedes it because it precedes all evidence other than the judge's knowledge. However, the judge must detail the conflict related to testimony and oath by referring to other indications and evidence. In cases where the expert opinion is merely an indication, if it leads to the judge’s knowledge, then the judge’s knowledge takes precedence over other evidence, otherwise other evidence takes precedence over the expert opinion; because in all cases, the evidence takes precedence over the indication.
