The Eligibility for Marriage in Imami and Hanafi Jurisprudence and Iraqi law

چکیده

ABSTRACT
The article deals with one of the important legal and jurisprudential topics, namely the topic of (the Capacity to marry); due to its importance and impact on Islamic society, and even humanity. There is no doubt that family relationships are among the most sublime and sacred relationships on earth. The family begins with two individuals (a man and a woman), then grows with the birth of children, and extends to include relatives and in-laws from both sides. The more interconnected family relationships are, the happier and contented the individual lives in them, and this positively affects the happiness and prosperity of society. Conversely, the more the family is exposed to disintegration due to the abundance of problems within it, this poses a danger to all members of the family, and then to society. The research in the article was a comparative research between Iraqi law on the one hand and Ahl al-Bayt jurisprudence and Hanafi jurisprudence on the other hand. The synthetic approach based on description and analysis was used. After extrapolating the information related to the issue and collecting the appropriate information, the descriptive, analytical, comparative approach was conducted to reach an objective result. At the end of the article, it becomes clear to us that the eligibility for marriage is considered one of the important issues decided by positive law and Islamic jurisprudence in family affairs. After comparing Iraqi law on the one hand and Ahl al-Bayt jurisprudence and Hanafi jurisprudence on the other hand, it becomes clear that there are issues in which Iraqi law shares with the two jurisprudences, and issues in which it differs. The conflict and difference between the law and the two jurisprudences were resolved - as much as possible - by combining the two opinions.
