Analysis of the primary property rights in al-Qasas and al-Diya from the perspective of Imamia and Sunni jurisprudence

چکیده

Parental (blood money) and retribution is the legal basis of Islamic law, the first one is the punishment for intentional killing and the second one is the punishment for wrongful killing. The jurists and scholars of law have raised many issues in this regard, but we have neglected so far the issue of the primary ownership of parental responsibility. The current research was carried out using the descriptive-analytical research method with the comparative studies method in order to investigate this issue and try to provide an answer to this issue, which, according to Imamiyyah and Sunni jurisprudence, the primary ownership of the right to retribution belongs to the deceased or the heirs. The results obtained indicate the existence of three statements in the problem. And the famous jurists of the Imamiyyah and the Republic of Ahl al-Sunnah say that the author of al-Bada'a is in al-Qasas and al-Majni is against him. But this ownership is temporary and then it is forcibly transferred to the heirs. Some of the Sunni schools of thought and the contemporary Imami jurists become the Al-Bada'i al-Haqq al-Qasas and al-Diyah for the heirs. While the chapter of the last chapter between the rights of retribution of the parents, Firi states that the retribution is the right of the heirs, the rights of the parents are the right of the heirs, the rights of the members are the rights of the victim, and the rights of the nafs are the rights of the heirs. The current study deals first with the concept of parental retribution, then it deals with the whole point of view of the above-mentioned viewpoints individually, and finally it is concluded that the theory of primitive ownership for heirs, although it has more strength and stability, it also complies with the requirements of the new age.
