This research addresses a delicate jurisprudential issue concerning the permissibility of delegating the guardian's permission for a virgin girl's marriage to another person. It does so through a comparative study of the opinions of early and later jurists. Key related concepts are analyzed, such as the jurists' criteria for defining virginity and the nature of the guardian's permission, while distinguishing between similar concepts like "ruling," "right," "permission," and "authorization." The study also examines the necessity or non-necessity of the guardian's permission for the marriage of a mature virgin, and the possibility of transferring or delegating this permission from a jurisprudential perspective. It discusses whether permission falls under the purview of guardianship or personal rights. The research employs a descriptive-analytical methodology, drawing upon jurisprudential and library sources, examining the opinions of jurists throughout history, analyzing relevant legal texts, and tracing developments in civil law.The study concluded that the guardian's permission is considered a matter of guardianship (ruling), not a right. Therefore, the majority of jurists stipulate the father's or paternal grandfather's permission for the marriage of a virgin adult woman. However, this permission cannot be delegated, as in any other agreement, from the husband to the wife or to a third party in a divorce document. Nevertheless, if the other party is explicitly identified and accepted by the guardian, the father—keeping in mind the essential purpose of this permission—may grant power of attorney to another person to declare the permission on his behalf. This eliminates the need for the husband's personal presence to declare his consent, thus facilitating the process and avoiding practical problems that might arise in this context.
