Intellectual property is a fundamental topic in Islamic jurisprudence and law, as it is directly linked to the protection of intellectual works and the encouragement of innovation. The core problem addressed by this study lies in the differing perspectives of Islamic jurisprudence and Iranian law concerning the legitimacy of intellectual property and copyright, with a focus on achieving a balance between individual rights and the public interest. This article aims to analyze the legal and jurisprudential foundations of intellectual property and identify the evidence for the legitimacy of copyright from the perspectives of legal scholars and Sunni and Imami jurists. The research employs a descriptive and analytical methodology based on library research and comparative analysis of jurisprudential texts and Iranian laws. The findings indicate that, from a legal perspective, intellectual property is an extension of physical property and guarantees the legitimate benefit derived from an individual's intellectual effort. From a jurisprudential perspective, the majority of Sunni jurists and a number of contemporary Imami jurists affirm the legitimacy of copyright, while acknowledging certain limitations or conditions related to the application of these rights. The study clarifies that the legal and jurisprudential protection of intellectual property promotes innovation and creativity, safeguards the public interest, and achieves justice.In conclusion, the research affirms the legitimacy of intellectual property rights and the importance of protecting intellectual and scientific output, while ensuring that its use aligns with the objectives of Islamic law and social development.
